Please read these terms of sale carefully before placing an order and retain a copy of these terms for future reference. By placing an order with EMC Tiles you are agreeing to these terms.
Ordering and format of the Contract
Trade Buyers not currently known to EMC Tiles must provide Registration details to the Company in order to be issued with a Log in and password. This will enable them to access Trade prices on the range of products available on the site.
Existing customers of EMC Tiles, whose e-mail details are known to us, will have been provided with a Log in and password to access the Trade part of the site. If you have not been provided with this information please contact us and we will provide this information to you.
After selecting your products from the range available you will proceed to the checkout area.
We will send you written conformation of your order by e-mail but no contract exists between the Company and the buyer until the Company has accepted your order and has received payment in full { cleared funds} from the buyer. The alternative method of payment would be on an agreed account {see below}
When these conditions are met and the goods are supplied to you then a contract for sale is made between us.
Your order will be based upon our product prices and delivery charges in force at the time you submit your order. If the prices or charges have changed and are different from those published this will be brought to your attention before we accept your order and will give you the option to cancel your order before we accept it.
These Terms and conditions are subject to UK law only.
Prices and Description of Goods
The description and price of the goods you order will be shown on the Company web site at the time you place the order.
The prices quoted on the web site are clearly displayed in Pounds sterling and are normally exclusive of VAT. Inclusive of VAT prices are obtainable by clicking on the relevant button.
Prices do not include the costs of delivery, details of which are set out below. Delivery charges are normally non- refundable unless the buyer is returning damaged or faulty products.
The goods are subject to availability. If on receipt of your order the goods are not available in stock the Company will inform you as soon as possible at the same time providing a time scale for the goods to be available. If this is not acceptable then you will be given the option of cancelling the order before we accept it.
The Delivery charges outlined below are for orders made online only and do not apply to those orders made in store. Also orders which are collected from our EMC Tiles outlets will not incur Delivery charges.
Orders made on a Friday {after 12.00pm}, Saturday, Sunday, or a Bank Holiday will be confirmed in writing on the next working day.
Delivery Charges
There are various options regarding delivery and these are detailed on our Web Site.
Options are-
• Collection from our Southglade Business Park, Hucknall Road , Nottingham, Warehouse is available and no delivery charge would apply
• Deliveries within a 25 mile radius of our Nottingham Warehouse would qualify for free delivery
• Apart from these options, you can then opt for either next day Delivery or Delivery within 3 to 5 working days. The charge would be based on weight and the geographical location of the Delivery. The Delivery charge would be shown on the pricing details as you are building up your order.
Delivery
Orders are normally delivered by various carriers and due to Health and Safety Regulations and Insurance issues we are unable to transport any goods into a property.
Many of the deliveries will arrive on a pallet and will be delivered to the nearest accessible location which may be the kerbside.
You must make arrangements necessary to take delivery of the goods when we deliver them in accordance with the delivery times for the charges you have paid for. If you do not accept delivery of the products or we are unable to deliver them because of errors or omissions on your part then we may charge you and you will be liable to pay us for all costs we incur.
On delivery the buyer shall have an obligation to check that the quantity, style, shade and size of the goods is as ordered and that the goods are received undamaged. Any discrepancies or damage must be notified to the Seller as soon as possible and within 24 hours of delivery and before the goods are fixed to a surface. The buyer should either take photographic evidence or must give the seller a fair chance to inspect the damaged goods.
The Seller shall have the right to deliver any goods ordered in instalments.
Payment Terms
There are various payment options on this Web site. These are :-
• Pay online. We accept all the major credit and debit cards. We would need full address details for verification purposes.
• Cleared funds being received before delivery takes place either by way of a BACS Payment or card payment processed through the branch.
• If paying by cheque then we would need at least 4 working days to ensure that the cheque is paid
• Payment on an agreed credit account with East Midlands Ceramics Ltd. If this is required the Company will supply the usual application form and references and credit checks will be taken before the account is opened and a credit limit agreed.
The Seller shall be entitled to invoice the buyer for the Price of the goods and any Delivery fee on or at any time after the order has been placed.
The buyer shall pay the Price for the goods immediately before the goods are released by way of cleared funds on receipt of the invoice unless the buyer has a Credit Account with the Seller in which case the Price shall be payable within 30 days from the date of the Seller's invoice, and the Seller shall be entitled to recover the Price, notwithstanding that delivery may not have taken place and the title in the goods has not passed to the buyer.
Shading
The buyer accepts that slight variations may appear in the colour and texture of the goods due to the nature of the materials used and the method of manufacture and the buyer shall not be entitled to reject the goods in respect of the same. No tiles can be guaranteed against crazing.
Any fault, quality or shading issues with the tiles will remain the responsibility of the Manufacturer. The seller accepts no liability for further or subsequential loss or expenses if the tiles are faulty, or not to the acceptance of the buyer. Any such issues will be passed to the Manufacturers, whereby any claims will become the Manufacturers sole liability, disclaimers or notes on boxes or packaging will become the duty of the buyer to read and accept prior to fixing.
Cancellation
Under the Distance selling regulations you have the legal right to cancel your order up to 7 days following delivery by informing us that you wish to cancel. If you cancel the order after despatch you must return to us the products you do not wish to keep {at your own cost} and we will provide a full refund. However, if we are required to collect the order then we will deduct reasonable costs in having to do so.
Cancellation of the order must be in writing, fax or e-mail stating clearly the reasons for cancellation.
Subject to above i.e. cancellation within 7 days of delivery, no order which has been accepted by the Seller may be cancelled by the buyer except with the agreement in writing of the Seller and on terms that the buyer shall indemnify the Seller in full against all loss (including loss of profit), costs, damages, charges and expenses incurred by the Seller as a result of cancellation.
The Seller shall not be liable to the buyer in the event that the incorrect quantity of goods are ordered by the buyer where such quantity has been calculated by the Seller using measurements supplied by the buyer or a third party.
Any product returned to EMC Tiles because of cancellation of order must be unused and returned in the original packaging and within 7 days of receipt of goods. In this case you will receive a refund of the cost of the goods and our delivery charges within 30 days of us receiving the returned goods.
However, if the goods are not in a fully re-saleable condition or the packaging is damaged we reserve the right to refuse to refund or deduct a proportion of the refund amount. This does not affect your statutory rights
Returns
In the event that the products are faulty or damaged on arrival you can exchange them or return those items in the following ways.
Exchange in Store
You must advise us by e-mail, quoting your order reference, within 24 hours of receipt of the goods when wishing to exchange goods in store. The e-mail should state the reasons why the goods are being exchanged, Photographic evidence would be helpful if possible.
An e-mail will be sent to you once the replacement goods are available in store for collection. You must take the faulty or damaged goods to the store along with your invoice. Exchanges are only possible for like for like products.
Exchange Direct via Courier
You must advise us by e-mail, quoting your order reference, within 24 hours of receipt of the goods when wishing to exchange goods via the Courier. The e-mail should state the reasons why the goods are being exchanged, Photographic evidence would be helpful if possible.
An e-mail will be sent to you once the replacement goods are available for delivery. We will arrange for replacement goods to be delivered and the faulty / damaged goods picked up at the same time. Replacement goods will normally be delivered within a 72 hour period.
Exchanges are only possible for like for like products.
Returns in Store
You must advise us by e-mail, quoting your order reference, within 24 hours of receipt of the goods when wishing to return goods in store. The e-mail should state the reasons why the goods are being returned, Photographic evidence would be helpful if possible.
If you are returning damaged or faulty products to one of our stores it should be done within 48 hours of receipt of goods. Simply take the item to your nearest store together with your invoice. You will receive a full refund including the delivery charges. Refunds are paid within 30 days of receipt of the returned order.
Returns via Courier
You must advise us by e-mail, quoting your order reference, within 24 hours of receipt of the goods when wishing to return goods via the Courier. The e-mail should state the reasons why the goods are being returned, Photographic evidence would be helpful if possible.
We will make arrangements for the courier to pick up the goods within a 5 to 7 day period. Goods will be inspected before agreeing a full or partial refund. Refunds would be paid within 30 days of receipt of the returned order.
The Delivery charge would normally be refunded for faulty or damaged goods, however, if more than one item was ordered and only one is being returned for being faulty or damaged then the delivery charge is not re-fundable.
Risk
Risk of damage to or loss of the goods shall pass to the buyer at the time of delivery, or if the buyer wrongfully fails to take delivery, the time when the Seller has tendered delivery of the goods.
In the event that the Seller agrees to deliver the goods (i) to a buyer who is not a consumer ("Trade Buyer") and (ii) to an address other than the Seller's premises ("the Trade Buyer's Address"), the Trade Buyer shall be responsible for, carry out and bear the risk of unloading the goods from the delivery vehicle at the Trade Buyer's Address and the Trade Buyer shall arrange, at its own cost, suitable lifting equipment and labour for that purpose. In the event that the Seller agrees to assist the Trade Buyer in unloading the goods, the risk of damage to or loss of the goods occurring during unloading shall be borne solely by the Trade Buyer.
