We are a hard wall & floor finishes retailer which also sells associated products and we sell and deliver such products to customers within the UK. Our business is based in England.

This Web site has been produced for our United Kingdom Mainland customers and we do not sell to customers located overseas via this website. If you are located overseas or not on the UK Mainland and wish to place an order then please contact us for further information.

These are Terms and conditions for goods purchased on our Website by a Consumer


1. The following conditions of sale shall apply to the purchase of goods from East Midlands Ceramics Ltd { emctiles } by a consumer making a purchase through our Website

2. If you are making a purchase other than through our website or you are not a consumer then the following terms and conditions apply

  •  For purchases made in one of our outlets then the terms and conditions displayed in store are applicable
  •  For Trade customers the terms and conditions known as T&C Trade customers apply

3. These conditions apply to the exclusion of all other terms and conditions

4. You acknowledge acceptance of these conditions of Sale on the placing of an order with us. Your order is an offer to buy goods from us, which we may either accept or reject. Where we accept, we will issue a written acceptance of your order, and at that point the contract between you and emctiles will come into existence on the basis of these conditions.

5. These conditions may not be varied except by our agreement in writing

6. Your statutory rights are not affected by anything set out in these conditions. Advice about your rights is available from your local Citizens Advice Bureau or Trading Standards Office

7. Where you are two or more persons the liability of such persons under the contract is joint and several.

8. The contract shall be governed by and interpreted in accordance with English law and you and emctiles will then submit to the jurisdiction of the English courts.


The content of this site including product prices, delivery charges, and product details are subject to change at any time without notice. We may also revise or update these terms and conditions at any time without notice. Use of this site and purchases of products offered for sale on this site are subject to the terms and conditions posted on the site at the time of your visit.

Please read these terms of sale carefully before placing an order and retain a copy of these terms for future reference. By placing an order with emctiles you are agreeing to these terms.

Description of Goods

The description of the goods you order will be shown on the Company web site at the time you place the order. All descriptions on the Website are for the purposes of giving an impression of the goods only and cannot be relied upon for selecting a purchase.

All specifications given to the customer are approximate and intended as a guide only. We always endeavor to ensure all product descriptions are correct, but advise customers to seek technical advice from qualified sources prior to ordering products and any work being carried out.

Any typographical, clerical or other error of omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by emctiles shall be subject to correction without any liability on our behalf.


The price of the goods you order will be shown on the Company Website at the time you place the order.

The prices quoted on the web site are clearly displayed in Pounds sterling and are normally inclusive of VAT.

Prices do not include the costs of delivery, details of which are set out below. Delivery charges are normally non-refundable unless the buyer is returning damaged or faulty products.

Prices quoted are based on current costs and subject to alteration to take account of any rise in such costs of if there has been an error or omission. If the price changes we will give you notice of this and the opportunity to cancel the order by giving us notice of withdrawal within 48 hours of being advised of the price alteration


The goods are subject to availability. If on receipt of your order the goods are not available in stock the Company will inform you as soon as possible at the same time providing a time scale for the goods to be available. If this is not acceptable then you will be given the option of cancelling the order before we accept it.

Clearance Tiles

Clearance Tiles are made from mixed shade / old batches or discontinued items hence being offered for sale at a significant discount from our normal sale prices.

The tiles cannot be returned and are non-refundable.

Sufficient tiles should be purchased plus a margin as we cannot guarantee future availability.

Once the present stock has been sold then these ranges will not be stocked in future.


Ordering and format of the Contract

After selecting your products from the range available you will proceed to the checkout area

We will send you written confirmation of your order by e-mail but no contract exists between the Company and the buyer until the Company has accepted your order and has received payment in full { cleared funds } from the buyer. The alternative method of payment would be on an agreed account { see below }

When these conditions are met and the goods are supplied to you then a contract for sale is made between us.

Any orders made on a Friday, Saturday, Sunday, or a Bank Holiday will be confirmed in writing and dispatched on the next working day (subject to stock availability).


The Delivery charges outlined below are for orders made online only and do not apply to those orders made in store. Also orders which are collected from our emctiles outlets will not incur Delivery charges.

Orders are normally delivered by various carriers and due to Health and Safety Regulations and Insurance issues we are unable to transport any goods into a property.

Our own vehicles are used for most local deliveries (DE, LE or NG postcodes). For all out of area deliveries, we use a third party transport company. When using third party transport companies, should any issues arise, or delays in delivery occur, EMC tiles cannot and will not accept any liability.

Many of the deliveries will arrive on a pallet and will be delivered to the nearest accessible location which may be the kerbside.

You must make arrangements necessary to take delivery of the goods when we deliver them in accordance with the delivery times for the charges you have paid for. If you do not accept delivery of the products or we are unable to deliver them because of errors or omissions on your part then we may charge you and you will be liable to pay us for all costs we incur.

On delivery the buyer shall have an obligation to check that the quantity, style, shade and Size of the goods is as ordered and that the goods are received undamaged.

Any discrepancies or damage must be notified to the Seller as soon as possible and within 24 hours of delivery and before the goods are fixed to a surface. The buyer should either Take photographic evidence or must give the seller a fair chance to inspect the damaged Goods.

The Seller shall have the right to deliver any goods ordered in instalments.

Delivery Charges

There are various options regarding delivery and these are detailed on our Web Site.

Options are –

  • Collection from any of our stores in Nottingham, Derby, Loughborough or Leicester and no delivery charge would apply.
  • You can opt for either Express Delivery within 24-48 hours or Economy Delivery within 2 to 5 working days from being dispatched. The charge would be based on weight and the geographical location of the Delivery. The Delivery charge would be shown on the pricing details as you are building up your order.

Payment Terms

There are various payment options on this Web site. These are :-

  • Pay online. We accept all the major credit and debit cards. We would need full address details for verification purposes.
  • Cleared funds being received before delivery takes place either by way of a BACS Payment or card payment processed through the branch.
  • If paying by cheque then we would need at least 5 working days to ensure that the cheque is paid
  • Payment on an agreed credit account with East Midlands Ceramics Ltd. If this is required the Company will supply the usual application form and references and credit checks will be taken before the account is opened and a credit limit agreed.

The Seller shall be entitled to invoice the buyer for the Price of the goods and any Delivery fee on or at any time after the order has been placed.  The buyer shall pay the Price for the goods immediately before the goods are released by way of cleared funds on receipt of the invoice unless the buyer has a Credit Account with the Seller in which case the Price shall be payable within 30 days from the date of the Seller’s invoice, and the Seller shall be entitled to recover the Price, notwithstanding that delivery may not have taken place and the title in the goods has not passed to the buyer.

Loyalty Points Scheme Rules

The East Midlands Ceramics Ltd Loyalty Points Scheme { “the scheme” } is a points based customer loyalty program open to customers buying products from emctiles and meeting the eligibility criteria of the scheme.

The scheme is owned by East Midlands Ceramics Ltd Company registered in England under Number 1435173.We also trade under the name of  emctiles

These rules together with the Company terms and conditions govern the collection and use of electronic points issued under the scheme. To participate in the scheme you must comply with these Rules, which should be read carefully.


  • To be eligible to join the scheme the customer must be registered on the emctiles Database as a Trade customer and have either a Trade Cash Sales account or a Trade Credit account.
  • We also require an accurate e-mail address for the Trade customer.
  • The account code for the customer will also be the account code for the loyalty points scheme.
  • The customer must have an address on the UK Mainland.
  • The Company reserves the right to refuse to accept a customer onto the loyalty points scheme at its own discretion.

Collecting Reward Points

  • To be able to start collecting points under the scheme the customer must first have been accepted onto the scheme by emctiles.
  • emctiles will maintain the Loyalty points details on their database. The Company may send you details of the number of loyalty points you have accumulated from time to time.
  • Points are earned each time the customer purchases goods from emctiles and an invoice is created. The number of points is based on the amount of the invoice including VAT. Therefore, for goods purchased totalling £100+VAT { 20% } then the number of points earned would be 120.
  • Loyalty points are lost when a credit note is provided against goods already purchased.
  • emctiles may from time to time advertise special offers so that additional Loyalty points can be earned.
  • The Customer referral scheme is now also linked to the loyalty points scheme and additional points can be earned through this. See the Rules of the scheme for full details.
  • The Company will correct any mistakes made in respect of the number of Loyalty points earned but recommends that you keep records of the transactions so that you can check whether the information held is accurate.

Redeeming Loyalty Points

  • Reward points will be redeemed in the order they were accrued.
  • Reward points must be redeemed within 12 months of the date they were created. Any points not redeemed within this timescale will be forfeited.
  • Reward points can be redeemed when goods have been purchased from emctiles and an invoice is being paid for. Effectively the loyalty points are another form of payment.
  • For an account, customer loyalty points can either be requested to be redeemed against their credit account and a suitable credit will then be issued or can be used as payment against outstanding invoices. Please contact Accounts department for further details.
    Redeemed loyalty points cannot be used again.
  • Loyalty points have no monetary value and cannot be exchanged for cash.
  • If you decide to withdraw from the scheme you must contact emctiles and formally request closure at which point the points accumulated can be used against products purchased from emctiles.
  • In the event that emctiles decides to close the scheme then 6 months’ notice will be given to customers using the scheme to provide sufficient time for the accumulated points to be redeemed.


  • emctiles may change the rules of the scheme at their absolute discretion with any changes published on the Company Web Site
  • emctiles are not liable for any tax liability that may arise from you taking part in scheme
  • The scheme is a standalone scheme and these rules should be read in conjunction with the Company sale Terms and conditions
  • These rules are governed by the laws of England.


The buyer accepts that slight variations may appear in the colour and texture of the goods due to the nature of the materials used and the method of manufacture and the buyer shall not be entitled to reject the goods in respect of the same. No tiles can be guaranteed against crazing.

Any fault, quality or shading issues with the tiles will remain the responsibility of the Manufacturer. The seller accepts no liability or further or subsequent loss or expenses if the tiles are faulty, or not to the acceptance of the buyer. Any such issues will be passed to the Manufacturers, whereby any claims will become the Manufacturers sole liability, disclaimers or notes on boxes or packaging will become the duty of the buyer to read and accept prior to fixing


Under the Distance selling regulations you have the legal right to cancel your order up to 7 days following delivery by informing us that you wish to cancel. If you cancel the order after dispatch you must return to us the products you do not wish to keep { at your own cost } and we will provide a full refund. However, if we are required to collect the order then we will deduct reasonable costs in having to do so.

Cancellation of the order must be in writing, fax or e-mail stating clearly the reasons for cancellation.

Subject to above i.e. cancellation within 7 days of delivery, no order which has been accepted by the Seller may be cancelled by the buyer except with the agreement in writing of the Seller and on terms that the buyer shall indemnify the Seller in full against all loss (including loss of profit), costs, damages, charges and expenses incurred by the Seller as a result of cancellation.

The Seller shall not be liable to the buyer in the event that the incorrect quantity of goods are ordered by the buyer where such quantity has been calculated by the Seller using measurements supplied by the buyer or a third party.

Any product returned to emctiles because of cancellation of order must be unused and returned in the original packaging and within 14 days of receipt of goods. In this case you will receive a refund of the cost of the goods and our delivery charges within 30 days of us receiving the returned goods.

However, if the goods are not in a fully re-saleable condition or the packaging is damaged we reserve the right to refuse to refund or deduct a proportion of the refund amount. This does not affect your statutory rights.

Exchange in Store

You must advise us by e-mail, quoting your order reference, within 24 hours of receipt of the goods when wishing to exchange goods in store. The e-mail should state the reasons why the goods are being exchanged, Photographic evidence would be helpful if possible.

An e-mail will be sent to you once the replacement goods are available in store for collection. You must take the faulty or damaged goods to the store along with your invoice. Exchanges are only possible for like for like products.

Exchange Direct via Courier

You must advise us by e-mail, quoting your order reference, within 24 hours of receipt of the goods when wishing to exchange goods via the Courier. The e-mail should state the reasons why the goods are being exchanged, Photographic evidence would be helpful if possible.

An e-mail will be sent to you once the replacement goods are available for delivery. We will arrange for replacement goods to be delivered and the faulty / damaged goods picked up at the same time. Replacement goods will normally be delivered within a 72 hour period.

Exchanges are only possible for like for like products.

Returns in Store

You must advise us by e-mail, quoting your order reference, within 24 hours of receipt of the goods when wishing to return goods in store. The e-mail should state the reasons why the goods are being returned, Photographic evidence would be helpful if possible.

If you are returning damaged or faulty products to one of our stores it should be done within 48 hours of receipt of goods. Simply take the item to your nearest store together with your invoice. You will receive a full refund including the delivery charges.  Refunds are paid within 30 days of receipt of the returned order.

Returns via Courier

You must advise us by e-mail, quoting your order reference, within 24 hours of receipt of the goods when wishing to return goods via the Courier. The e-mail should state the reasons why the goods are being returned, Photographic evidence would be helpful if possible.

We will make arrangements for the courier to pick up the goods within a 5 to 7 day period. Goods will be inspected before agreeing a full or partial refund. Refunds would be paid within 30 days of receipt of the returned order.

The Delivery charge would normally be refunded for faulty or damaged goods, however, if more than one item was ordered and only one is being returned for being faulty or damaged then the delivery charge is not re-fundable.


Risk of damage to or loss of the goods shall pass to the buyer at the time of delivery, or if the buyer wrongfully fails to take delivery, the time when the Seller has tendered delivery of the goods.

In the event that the Seller agrees to deliver the goods to an address other than the Buyers premises then the buyer shall be responsible for, carry out and bear the risk of  unloading the goods from the delivery vehicle at the Address and the Buyer shall arrange, at its own cost, suitable lifting equipment and labour for that purpose.  In the event that the Seller agrees to assist the Buyer in unloading the goods, the risk of damage to or loss of the goods occurring during unloading shall be borne solely by the Buyer.

All rights, including copyright, in this web site are owned or licensed by us. Any use of this website or its contents, including copying or storing them without permission is prohibited.
